I have a provisional Partner visa - can I include my dependent child in my permanent visa application ?

The Dependent Child (temporary) visa is a provisional visa that enables a dependent child of a holder of a provisional Partner visa to travel to/remain in Australia for the same period as their parent. (This visa is mainly aimed at students over the age of 18 as there are other visas for children under 18 which are usually more appropriate. In most cases, dependent children are simply added to the visa application of the parent . eg for skilled migration visas.)

Once this visa has been granted, the child can apply to be added to their parent's permanent Partner visa application.


What are the visa requirements for a Dependent Child (temporary) visa ?

For a Dependent Child (temporary) visa, a child must be the dependent child of their parent who is the holder of a :

  • subclass 309 Spouse (provisional) visa,
  • subclass 310 Interdependency (provisional) visa,
  • subclass 445 Dependent Child (temporary) visa,
  • subclass 820 Spouse (provisional) visa, or
  • subclass 826 Interdependency visa.

This parent is termed the 'visa-holding parent'. The child must also :

  • be sponsored by his/her visa-holding parent's sponsor,
  • satisfy public interest criteria, and
  • satisfy custody criteria.

There is no age limit or requirement that the applicant be a full-time student for this visa.
A child under 18 is automatically a Dependent Child.

A child 18 or over has to be financially reliant on their visa-holding parent for the majority of their basic needs for food, clothing and shelter.


How can a Dependent Child apply for a permanent visa ?

Once a child has been granted a Dependent Child (temporary) visa, they can apply to be added to their parent's permanent partner visa application.
